It was a Wednesday afternoon in the fall of 2014, when Nathaniel and Jessica Waggoner were stopped at the light on US-1 and Shore Drive in St. Johns County. All of a sudden, their car was violently hit from behind.
The force of the impact threw the Waggoner’s car into a terrifying spin, tossing them across the roadway and into a ditch. The couple both suffered terrible injuries in the crash.
Multiple Surgeries and Spinal Injuries
Mrs. Waggoner underwent years of treatment and surgeries including an anterior cervical discectomy and a fusion at C5/C6 and is still undergoing therapy.
Just prior to the crash, Mr. Waggoner had undergone biceps surgery and the crash ripped the anchors placed during that surgery. He had another surgery to his biceps which failed, and now needs a third biceps surgery. After years of treatment, Mr. Waggoner also had surgery, L3/L4 bilateral posterior lumbar decompression, and is scheduled to undergo implantation of a spinal cord stimulator because of his unrelenting lower back pain.
Complicated Case
This sounds like it should be an open and shut case. But the defendant driver passed away, due to unrelated causes, after the complaint was filed. It would be a battle of nearly two years of litigation and preparation for trial, and significant expenses to make sure the Waggoners would be treated fairly.
